2. Research use only
All products supplied by GenoGla Diagnostics, and all results returned by the total-GRP analysis service, are for research use only.
They are not medical devices or in vitro diagnostic medical devices within the meaning of Regulation (EU) 2017/746. They are not intended for use in diagnostic or therapeutic procedures, for clinical decision making, for screening, or for administration to humans or animals. They have not been evaluated or approved by any regulatory authority for any clinical purpose.
The customer is responsible for using the products and results only for internal research purposes, in accordance with applicable law, institutional biosafety rules, and any ethical approvals required for the samples analysed.
3. Terms and conditions of sale and service
3.1 Scope
These terms govern the supply of research reagents and the provision of the total-GRP analysis service by GenoGla Diagnostics. They apply to every order unless a separate written agreement is signed by both parties. By placing an order you accept these terms.
3.2 Quotations and orders
Quotations are valid for 30 days from the date of issue unless stated otherwise. An order is accepted only when GenoGla Diagnostics confirms it in writing. GenoGla Diagnostics may decline an order, in particular where the intended use is inconsistent with section 2.
3.3 Prices, taxes and payment
Prices shown on this website are in euros and exclude value added tax. The applicable VAT rate is added at invoicing according to the customer's country and VAT status. Customers within the European Union who supply a valid VAT identification number verifiable in VIES may be invoiced under the reverse charge mechanism. Prices exclude shipping, insurance, customs duties and import charges, which are shown separately before the order is confirmed.
Where an order is placed by a consumer, the total price including all taxes and delivery charges is shown before the order is placed.
Payment is by bank transfer or by card through our payment provider. Unless agreed otherwise, payment is due before dispatch of goods or before release of analysis results.
3.4 Delivery and cold chain
Reagents are temperature sensitive and are shipped under controlled conditions. Delivery times are estimates and depend on destination and carrier. Risk passes to the customer on delivery.
The customer must inspect the shipment on arrival and notify GenoGla Diagnostics in writing of any damage, shortage or temperature excursion within seven days of delivery. Claims notified after that period cannot be accepted, because the integrity of biological reagents cannot be verified retrospectively.
3.5 Samples submitted for analysis
The customer warrants that all samples submitted for analysis were collected lawfully, with any consent and ethical approval required in the customer's jurisdiction, and that they are supplied to GenoGla Diagnostics in pseudonymised or anonymised form. The customer must not send direct identifiers of any individual.
Samples are handled as potentially infectious material. GenoGla Diagnostics may refuse or destroy any sample that arrives damaged, improperly labelled, improperly packaged, or outside the specified conditions. Residual sample material is retained for the period stated in the quotation and then destroyed.
Results are supplied as a quantitative report. GenoGla Diagnostics does not interpret results clinically and makes no statement about the health of any individual.
3.6 Warranty and limitation of liability
GenoGla Diagnostics warrants that products conform to the specifications in the applicable datasheet when stored and handled as instructed, until the stated expiry date. The sole remedy for a non-conforming product is replacement or refund of the price paid, at our option.
Because products are supplied for research use, no warranty is given as to fitness for any particular experimental design, protocol, sample type or application not listed as validated in the datasheet.
To the extent permitted by law, the total liability of GenoGla Diagnostics arising from any order is limited to the amount paid for that order. GenoGla Diagnostics is not liable for loss of data, loss of samples, loss of profit, or any indirect or consequential loss. Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under Portuguese law.
3.7 Restrictions
Products may not be resold, redistributed, transferred to third parties, reverse engineered, or used to produce derivative or competing materials, without prior written consent.
3.8 Publication and citation
Customers publishing work that used GenoGla Diagnostics products or services are asked to cite the product reference and, where applicable, the analysis service. This is a request, not a condition of sale.
3.9 Consumer rights
Where the customer is a consumer within the meaning of Portuguese law, the following applies in addition and nothing in these terms limits mandatory consumer rights.
Right of withdrawal: a consumer may withdraw from a distance contract within 14 days of receiving the goods, or of conclusion of the contract for services, without giving a reason, in accordance with Decree-Law 24/2014 of 14 February. To exercise it, send an unambiguous statement to genogla@genogla.com.
Exceptions to the right of withdrawal: under Article 17 of Decree-Law 24/2014, the right does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed after delivery, nor to goods liable to deteriorate or expire rapidly. Both exceptions apply to temperature sensitive biological reagents.
Legal guarantee of conformity: consumers benefit from the legal guarantee under Decree-Law 84/2021 of 18 October.
3.10 Force majeure
Neither party is liable for failure to perform caused by events beyond its reasonable control, including carrier failure, customs delay, and interruption of supply of critical materials.
4. Privacy policy
4.1 Controller
The controller of personal data collected through this website is GENOGLA DIAGNOSTICS, LDA., with the details in section 1. For any question about this policy or to exercise your rights, contact genogla@genogla.com.
GenoGla Diagnostics has not appointed a data protection officer, as it is not required to do so under Article 37 of the General Data Protection Regulation.
4.2 What we collect and why
Contact and quotation form: name, email address, institution or company, enquiry type, and the content of your message. We use this to answer your enquiry and to prepare a quotation. Legal basis: Article 6(1)(b) GDPR, steps taken at your request prior to entering into a contract, and Article 6(1)(f) GDPR, our legitimate interest in responding to business enquiries.
Order and invoicing data: name, institution, billing and delivery address, VAT number, and payment reference. Legal basis: Article 6(1)(b) GDPR for performance of the contract, and Article 6(1)(c) GDPR for compliance with Portuguese accounting and tax obligations.
Server and technical data: your IP address and browser information are processed by our hosting provider to deliver the site and maintain its security. Legal basis: Article 6(1)(f) GDPR.
We do not use this website to collect health data, and we do not collect personal data about the individuals from whom research samples originate. Samples must reach us pseudonymised or anonymised.
4.3 Processors and recipients
We use third parties who process personal data on our behalf under written agreements: our website hosting provider, our form delivery provider, our payment provider, and our carrier for shipments. We also share invoicing data with our accountants and with the tax authority where required by law.
Where a processor is established outside the European Economic Area, the transfer is made on the basis of an adequacy decision of the European Commission or of standard contractual clauses adopted under Article 46 GDPR.
We do not sell personal data and we do not use it for automated decision making or profiling.
4.4 Retention
Enquiry and quotation data is kept for 24 months from the last contact. Contractual and invoicing data is kept for 10 years, as required by Portuguese tax law. Data is deleted or anonymised at the end of these periods.
4.5 Your rights
You have the right to access your personal data, to have it rectified or erased, to restrict or object to its processing, and to data portability. Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
To exercise these rights, contact genogla@genogla.com. You also have the right to lodge a complaint with the Portuguese supervisory authority, the Comissão Nacional de Proteção de Dados, at www.cnpd.pt.
5. Cookie policy
This website uses only cookies and equivalent local storage that are strictly necessary for the site to function and to remain secure. These are exempt from the prior consent requirement under Article 5(3) of Law 41/2004 of 18 August.
We do not use analytics, advertising, or tracking cookies. If that changes, a consent banner will be presented before any non-essential cookie is set, and this section will be updated with a list of the cookies used, their purpose, and their duration.
You can block or delete cookies through your browser settings. Blocking strictly necessary cookies may prevent parts of the site from working.
6. Intellectual property
The content of this website, including text, layout, graphics and the GenoGla name and logo, is the property of GenoGla Diagnostics or is used with permission, and may not be reproduced without written consent. Datasheets may be downloaded and used internally for research purposes.
The technology underlying the GRP portfolio is based on PCT patent application PCT/PT2009000046, owned by the University of Algarve and CCMAR, licensed to GenoGla Diagnostics. Product references, clone identities and immunogen sequences are proprietary and are not disclosed.
Third party trademarks and publication references appear for identification purposes only.

8. Governing law and jurisdiction
These terms and any dispute arising from them are governed by Portuguese law. The courts of the district of Faro, Portugal, have exclusive jurisdiction, except where a consumer is entitled by law to bring proceedings before the courts of their place of residence.
